3. Use and Sharing of Information

- With Educational Entities: We share Student PII with schools, school districts, and other educational entities to support their educational programs and comply with our contractual obligations.
- With Consent: We may share Student PII with third parties when we have obtained explicit consent from the student (if over 18 or legally emancipated) or from the parent or guardian.
- Legal and Safety Reasons: We may disclose Student PII to comply with legal obligations, respond to subpoenas, court orders, or other legal processes, protect the safety of our users, and investigate or prevent illegal activities or violations of our terms of service.

- During the Contract Term: We retain Student PII for the duration of our contract with an educational entity. Upon request from the educational entity, we will destroy Student PII as soon as practicable, unless retention is authorized by the student (if over 18 or legally emancipated) or parent, or requested by another educational entity to which the student has transferred.
- Post-Contract Term: Following the termination or conclusion of a contract, we will destroy all Student PII collected, generated, or inferred as a result of the contract within the time period specified in the contract. If no period is specified, we will destroy the information when it is no longer needed for contractual purposes. We will notify the educational entity of the date upon which all Student PII is destroyed.
7. Notification of Changes
We will provide clear notice to educational entities before making material changes to this Privacy Policy. Updated policies will be posted on our website, and educational entities will be informed of any significant changes to ensure they are aware of and understand the implications of these changes.
8. Prohibited Practices
We adhere to strict guidelines regarding the use of Student PII:
- No Sale of Information: We do not sell Student PII. This prohibition includes transferring or selling Student PII to third parties, except in the event of a merger, acquisition, or other type of acquisition of Eduvero, provided that the successor entity complies with this Privacy Policy.
- No Targeted Advertising: We do not use or share Student PII for purposes of targeted advertising to students.
- No Unauthorized Profiling: We do not use Student PII to create personal profiles for purposes other than educational support as authorized by the contracting educational entity or with the student’s or parent’s consent.
9. Reporting Misuse
If we discover the misuse or unauthorized release of Student PII, we will notify the affected educational entity as soon as possible, regardless of whether the misuse results from a material breach of contract. This notification will include the nature of the misuse, the specific data involved, and the steps taken to mitigate any harm.
10. Use and Disclosure Exceptions
We may use or disclose Student PII without consent in specific circumstances, including:
- Legal Compliance: To comply with laws, regulations, or legal processes.
- Judicial Process: To respond to subpoenas, court orders, or other legal proceedings.
- Safety and Security: To protect the safety of users, investigate security incidents, or prevent harm.
- Public Safety: To investigate matters related to public safety.
In these cases, we will notify the contracting educational entity as soon as possible after the use or disclosure of the information.
11. Subcontractors and Data Sharing
We may use or disclose Student PII to subcontractors only if they are contractually required to comply with our data transparency, data security, and data destruction policies. Subcontractors must adhere to the same standards and obligations that apply to us regarding the protection of Student PII. If a subcontractor commits a material breach involving the misuse or unauthorized release of Student PII, we will terminate the contract with the subcontractor and notify the educational entity.
12. Student Consent
A student may consent to the use, sharing, or retention of their Student PII only if they are at least eighteen years of age or legally emancipated. Otherwise, consent must be obtained from the student’s parent or legal guardian.
13. Information Security Program
We maintain a comprehensive Information Security Program that includes:
- Administrative Safeguards: Policies and procedures to manage the selection, development, implementation, and maintenance of security measures.
- Technological Safeguards: Technology and procedures to protect against unauthorized access and to ensure the integrity and confidentiality of Student PII.

If an educational entity requests the destruction of Student PII collected, generated, or inferred as a result of the contract, we will destroy the information as soon as practicable unless:
- Retention Consent: We obtain the consent of the student (if over 18 or legally emancipated) or parent to retain the information.
- Transfer Request: The student has transferred to another educational entity that requests the retention of the information.
